These GTC apply to all legal transactions concluded between Kaufmann Trading (‘we’, ‘us’, ‘our’) and its customers (‘you’, “your”, ‘yours’) via or in connection with the online shops shopping-trolley.ch and carlett.ch.

By using our websites and/or placing an order with us (including via other channels, such as by email or telephone), you expressly agree to these GTC.

We reserve the right to change these GTC at any time. The version of these GTC valid at the time of the order is decisive and cannot be changed unilaterally for this order. Any terms and conditions of the customer that conflict with or deviate from these GTC will not be recognised.

 

Offer

The offer is available on the website and is non-binding. All information (product descriptions, images, films, dimensions, weights, technical specifications, accessory relationships and other information) is subject to error and does not constitute a guarantee of characteristics.

We reserve the right to make changes to prices and product ranges, as well as technical changes, model changes and colour variations.

Clerical or pricing errors due to mistakes or transmission errors are non-binding.

The offer is primarily aimed at end consumers (companies and private individuals). We reserve the right not to accept orders in quantities that are not customary for households or to reduce them at our own discretion. We also reserve the right to block customer accounts at our own discretion without giving reasons.

 

Conclusion of contract

Our offer constitutes a non-binding invitation to you to order goods from us. By placing your order, you accept these terms and conditions and submit a legally binding offer to conclude a contract. An order cannot be cancelled without our express consent.

You are responsible for providing a correct delivery address and contact details (email address and, if applicable, telephone number) when placing your order.

The receipt of an online order will be confirmed by an automatically generated order confirmation sent to the email address you provided. This email does not constitute acceptance of the offer. It only indicates that we have received the order you placed.

A contract is only concluded when we send you a declaration of acceptance by email (shipping confirmation). If you do not receive a shipping confirmation, the actual shipment of the goods by us shall be deemed acceptance of your offer.

In the event of obvious pricing errors in our offers, we reserve the right to reject the order.

Every order to be delivered is subject to receipt of payment and the availability of goods and delivery by us or our fulfilment partners and suppliers.

If, after conclusion of the contract, it transpires that the ordered goods cannot be delivered, either in part or in full, for reasons beyond our control, we are entitled to withdraw from the contract in whole or in part.

 

Purchase price and terms of payment

The price to be paid consists of the price of the selected product(s), VAT and, if applicable, a minimum quantity surcharge and a share of the shipping and packaging costs. All these elements will be displayed to you before you submit your purchase offer. The price stated in the order confirmation is decisive.

The sales price is payable immediately and must be paid in Swiss francs. We will only ship the goods after receipt of payment (in the case of prepayment) or when the payment provider has informed us that your payment has been authorised.

We use the services of various payment providers to process your payment. By using these payment options, you agree to the applicable terms and conditions and data protection provisions.

 

Purchase on account

 

Private individuals and companies listed in the commercial register (HR): Purchase on account with instalment option (Powerpay)

For private individuals and companies listed in the commercial register, we offer payment by invoice including the option of instalments. Payment processing is carried out in cooperation with our partner Powerpay.

You will receive the invoice from Powerpay free of charge by e-mail, provided you have a valid e-mail address.

MF Group / POWERPAY is an external payment service provider offering the ‘purchase on account’ payment method. With the individual invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified time frame, you will receive a monthly invoice with an order overview in the following month.

Upon conclusion of the purchase contract, POWERPAY takes over the invoice claim and handles the corresponding payment modalities. When purchasing on account, you accept the terms and conditions of POWERPAY (powerpay.ch/en/terms-and-conditions) in addition to our terms and conditions.

In the event of late payment, MF Group / POWERPAY may charge you reminder and collection fees; these can be found in the POWERPAY terms and conditions (powerpay.ch/en/terms).

 

Organisations without HR registration

Institutions, organisations and companies that are not entered in the commercial register (e.g. public administrations, schools, municipalities) can still purchase from us on account. Please contact us by email for this purpose.

With this option, we generally only deliver against advance payment. However, we can make exceptions for public bodies and in urgent cases.

Invoices are only generated electronically (PDF) and sent by email.

If your prepayment does not reach our account within 14 days, we reserve the right to cancel your order without further notice. If you require a longer payment period, please contact us by email.

 

Delivery and delivery dates

We deliver from our Swiss warehouse to Switzerland and Liechtenstein. The products available for order are usually in stock and can be delivered quickly. Information on delivery times can be found under the menu item Shipping and, if applicable, on the individual product pages. In general, you can expect a delivery time of between 1-5 working days.

Delivery times and, where applicable, delivery dates are provided by us to the best of our knowledge. We reserve the right to longer delivery times, and any delays do not entitle you to cancel the order or claim compensation.

We reserve the right to make partial deliveries if this seems expedient for the efficient processing of the entire delivery or is necessary for operational reasons. In such cases, we will of course not charge any additional shipping costs.

If a parcel is undeliverable or you refuse to accept it and the parcel is returned, we will treat it as a return (see ‘Exchanges and returns’ below).

 

Benefit and risk

The transfer of benefit and risk from us to you takes place at the time of dispatch of the purchased item from our warehouse or a logistics centre commissioned by us to the address you have specified. This provision also applies to partial purchases or partial deliveries.

 

Retention of title

Delivered goods remain our property until full payment has been received. We are entitled to have a corresponding reservation entered in the public register.

 

Complaints

Complaints must be made in writing within 7 days of receipt of the shipment or acceptance of the goods, even in the case of partial deliveries. Complaints about poor packaging must be made on the day after receipt of the shipment. The packaging will not be taken back.

If you have a complaint, please contact our customer service department by e-mail and attach one or more good photos of the issue in question.

 

Incorrect delivery and transport damage

Packages are delivered by Swiss Post. We therefore cannot guarantee punctual and correct delivery and are not liable for late or incorrect delivery or for transport damage.

If the parcel is visibly damaged on the outside, you must express your reservations to the postman upon receipt of the parcel. Consumer protection recommends the following statement: ‘As the parcel shows signs of external damage, I reserve the right to report transport damage.’

 

Incomplete delivery

In the event of an incomplete delivery, we will deliver the missing items to you, provided they are still available. Otherwise, we will refund the purchase price.

Exchanges, returns and cancellations


Exchanges and returns

We accept returns or exchanges up to 14 days after purchase under the following conditions:

If the condition of the returned item does not meet the above conditions, we reserve the right to charge you for the repair costs incurred to restore the item to a saleable condition (up to a maximum of the original sale price).

You are responsible for the costs of return shipping.

 

Procedure

Log in to your customer account at https://account.shopping-trolley.ch/ using the email address you used when making your purchase. There you will see your orders. You can register a return here up to 14 days after purchase. Please state the reason for the return.
We will then send you a return label by email. Print out the return label.
Pack the items you wish to return in a cardboard box. Include the order confirmation or proof of purchase.
Stick the return label on the bottom right of the cardboard box.
Hand over the cardboard box to Swiss Post.

 

Refund and credit note

As soon as we have received your return, we will check the goods and refund the purchase price, minus the return shipping costs and any repair costs. The refund will be made using the same method you used to pay. If you used the ‘purchase on account’ payment method, the Powerpay refund process will apply.

On request, we can issue you with a credit note in the online shop instead of a refund.

 

Cancellations

Cancellations are free of charge as long as the order has not yet been processed. To do so, please contact our customer service team by email. Cancellation requests must be confirmed by us. If the order has already been processed, we will treat your cancellation request as a return.

 

Warranty

We provide a 2-year warranty for the defect-free condition and functionality of the product you have ordered. We can fulfil the warranty either by repair, partial or complete replacement with an identical product, credit note at the current daily price (max. the sales price at the time of ordering) or reduction. You are not entitled to commission a third party to carry out the repair. In such a case, there is no entitlement to reimbursement of costs.

For defects attributable to a material or manufacturing fault, Andersen Shopper Manufaktur and Carlett offer you a 3-year manufacturer's warranty on all products from the date of initial delivery of the goods.

Normal wear and tear does not constitute grounds for a warranty claim. Consumables such as batteries are excluded from the warranty.

The warranty claim expires in the event of technical intervention and defects that are attributable to improper handling, excessive strain, misuse, external influences (moisture damage, contact with liquids, impacts, etc.) or failure to observe the manufacturer's instructions for use or maintenance.

Hidden defects must be reported to us in writing immediately after discovery and documented with photographs.

 

Procedure

To make a claim under your warranty, please contact our customer service department by email. We will need a description of the defect, good-quality photos clearly showing the defect in question, and the original invoice with the order number.

Any necessary transport costs shall be borne by you and at your risk. If a defect to be remedied is not covered by the warranty and you could have recognised this, you shall bear the costs incurred for the inspection.

Unless otherwise agreed in writing, we shall not be liable for damages resulting from the non-fulfilment or incorrect fulfilment of the purchase contract or for the operation or use of the purchased item. In any case, however, we accept no liability for lost profits, indirect or consequential damages that may arise for you or a third party.

 

Data protection

The privacy policy is an integral part of these GTC. By accepting these GTC, you also agree to the privacy policy (https://www.shopping-trolley.ch/policies/privacy-policy).

 

Dispute resolution and place of jurisdiction

Swiss law applies exclusively. The place of jurisdiction for any disputes is Arlesheim, unless another place of jurisdiction is required by law.

We are entitled to be represented in whole or in part by our suppliers in court and out-of-court proceedings at our discretion. Your consent is deemed to have been given in such cases.
